Terms of Service

1. Acceptance of Terms

By accessing or using Samus, an AI-assisted product development platform operated by Edaphic Corporation ("Edaphic," "we," "us," or "our"), available at app.samus.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Samus is an AI-assisted product development platform that helps users turn ideas into structured product work through conversational AI, requirements discovery, artifact generation (user flows, statements of work), and automated build and deployment tooling. The Service includes features such as chat-based project planning, document analysis, code generation, GitHub integration, Railway deployment, and build progress notifications via email and SMS.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Generate, store, or transmit malicious code, malware, or harmful content
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to develop competing products or services
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use the AI features to generate content that is illegal, harmful, or violates the rights of others
• Misrepresent your identity or impersonate any person or entity

5. User Content

You retain ownership of the content you create, upload, or share through the Service ("User Content"), including project descriptions, documents, conversations, and generated artifacts. By using the Service, you grant Samus a limited, non-exclusive license to process your User Content solely as necessary to provide and improve the Service.

You are responsible for ensuring that your User Content does not violate any applicable laws or infringe on the rights of any third party. We reserve the right to remove content that violates these Terms.

6. AI-Generated Content

The Service uses artificial intelligence to assist with product development, generate suggestions, create artifacts, and produce code. AI-generated content is provided "as is" and may contain errors or inaccuracies. You are responsible for reviewing, testing, and validating all AI-generated output before using it in production. Samus does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content.

The Service integrates with third-party platforms including GitHub, Railway, and various AI model providers. Your use of these integrations is subject to the respective third party's terms of service and privacy policies. Samus is not responsible for the actions, content, or policies of third-party services. When you connect an integration, you authorize Samus to access and interact with those services on your behalf within the scope you have granted.

9. Intellectual Property

The Service, including its design, features, code, trademarks, and underlying technology, is owned by Samus and protected by intellectual property laws. These Terms do not grant you any right to use the Samus name, logo, or branding without our prior written consent. Nothing in these Terms transfers any intellectual property rights to you except the limited rights expressly granted herein.

To the maximum extent permitted by law, Samus and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting us. Sections of these Terms that by their nature should survive termination shall continue in effect.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable rules, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.
